Under Contract, Conditional, Unconditional: What It Means for Buyers

Nothing is more frustrating than finding a home that looks perfect online, only to call and hear: “We do have a contract in place.”
It can feel like a mixed signal because the property still appears For Sale. At The Agency CQ, there is a simple reason for that, and if you are a serious buyer it can work in your favour.
Our rule: we don’t label “Under Offer” until the contract is unconditional
Internally, our standard is clear. We do not change a property’s public status to Under Offer until the contract is unconditional.
While a buyer is working through the conditional stage (commonly finance approval, building and pest inspections, or another condition), the listing remains live. During this window, we may still be:
- Taking enquiries from interested buyers
- Showing the property (where appropriate)
- Keeping a list of backup buyers, in case the contract does not proceed
This is not about playing games. Until a contract is unconditional, the outcome is not guaranteed. We owe it to our sellers to maintain momentum until the contract is fully locked in.
Why we keep the door open
In a perfect world, every contract would move smoothly to unconditional. In reality, life happens. A conditional contract can fall through for reasons such as:
- Finance delays or a decline
- Building and pest concerns the parties cannot resolve
- A buyer’s own sale not proceeding
- A change in circumstances during the conditional period
If a deal collapses, the seller needs a Plan B immediately. Keeping the campaign active helps us respond quickly, and it gives prepared buyers a real second chance.
Why you should raise your hand anyway
When buyers hear there is a contract in place, many disengage and disappear. That is often a mistake. If you tell us you are interested, you put yourself in the best position if circumstances change.
By staying in the conversation, we can:
- Keep you updated where we can, while respecting confidentiality
- Contact you quickly if the property becomes available again
- Help you prepare a strong backup position, so you can act decisively
- Guide you on terms and timing that can make your offer more attractive
In a fast-moving market, that second opportunity can appear and disappear quickly.
